WOW Sight & Sound Terms & Conditions of Use

Welcome to the WOW Internet Service provided to you by G & M Direct 2 U Pty Ltd trading as WOW Sight & Sound ("WOW"), ABN 63 152 625 977 of Suite 306, Locked Bag 1, Robina Town Centre, 4230, Queensland, Australia. By accessing the Service, you agree to be bound by the Terms and Conditions which are set out below.

These may be updated or changed from time to time and you should therefore check them each time you use the Service.

Please read these Terms and Conditions carefully. If you do not agree with these Terms and Conditions, do not access this Service or use any of its services.

By entering and using the Service, you accept these Terms and Conditions and agree to be legally bound and subject to them. Acceptance of the Terms and Conditions creates a binding legal agreement between you and WOW. You must comply with these Terms and Conditions and use the Service only in a manner consistent with them.

While WOW will endeavour to supply your order, it reserves the right at any time prior to delivery, to cancel at its discretion, any order it receives from you and to refund to you or your funds provider any monies received by WOW in relation to such order.

  1. Use of Service
    1. You must not access the Website or use the Service if such access or use by you is illegal or prohibited.
    2. Use of the Service is at your risk. WOW accepts no responsibility for any loss or damage which may arise in connection with access to this Website or the Service.
    3. The Website may contain links to other web sites. WOW takes no responsibility for the content or privacy practices associated with any linked web sites.
    4. All Intellectual Property in the WebPages of the Website is the property of WOW, its advertisers or third party providers. Unless expressly authorised under this Agreement, you may not reproduce adapt, modify, display, perform or distribute any Material or any part of any Material.
  2. Membership
    1. To place an Order you have the option of becoming a member and create an Account. To do so, you must enter your name, your chosen password, your email address (which must be a genuine email address) and have received from us by email, confirmation of your membership. Only one membership is permitted for each email address. Membership will enable the member to use any of the services described on this site for members.
    2. You warrant that all information provided by you when creating your Account is accurate and up to date.
    3. To obtain and maintain membership you must not own or have registered in your name (or any other name by which you are known) more than four (4) prepaid mobile accounts.
    4. You will be informed of the status of your account via the email address you have provided in your application.
    5. If you breach any of these Terms and Conditions we will be entitled to terminate the membership without notice.
  3. Password and Account

    You are responsible for maintaining the confidentiality of your password and account details.

  4. Orders
    1. Orders are deemed received only upon WOW sending a confirmation to your nominated e-mail address.
    2. Upon acceptance of your Order we agree to supply of the goods described in the Order. These Terms and Conditions apply to that agreement.
    3. Orders of commercial quantities of goods may be rejected by WOW in its absolute discretion.
    4. WOW will use its best endeavours to supply, however reserves the right to cancel any Order without notice for any reason. If an Order is cancelled, all payments processed by WOW will be refunded forthwith.
    5. To cancel an Order you must notify us (customer.service@1wow.com.au ) or phone 1300 513 504 Monday - Friday 8.00am - 8.00pm EST by 9am by the next business day following the date of Order, quoting the Order reference number. Accepted Orders which have already been shipped cannot be cancelled in any circumstances.
    6. WOW accepts no responsibility for Orders not processed or not accepted for reasons beyond our control.
    7. You warrant that if purchasing Restricted Material that that you are lawfully entitled to do so.
  5. Pricing
    1. Prices displayed on the Website are subject to change without notice. Prices for Orders are fixed at the time the Order is accepted. Subsequent price changes will not apply to previously accepted Orders.
    2. Pricing does not include freight or delivery charges which you agree to pay at the time of your Order.
    3. You agree to pay the delivery charges specified at the time you submit your Order.
      The WOW Free Freight limited promotion applies to standard shipping services to Australian addresses only. Excludes remote locations that require light aircraft or barge transport, and only applies to mainland Australia.
  6. Payment
    1. You may pay for your order by providing your credit or debit card details via PayPal Secure Payment Service.
    2. If you choose to use PayPal for payment for membership, you will be required to provide additional identification information.
    3. You warrant that the account linked to your nominated payment type is owned by you. This applies to PayPal, debit or credit card transactions
    4. Once your Order is accepted, WOW will process payment (including any delivery charges).
    5. You authorise WOW to process payment in the manner nominated by you in the Order.
    6. If payment is declined, WOW will not fulfil your Order and may contact you to make alternative payment and delivery arrangements.
    7. WOW may decline to accept payment from you by credit card for any reason. In those circumstances, we will not process the Order and may not contact you to make alternative payment arrangements.
    8. Gift Cards issued prior to 01/05/2012 are not available for redemption.
      Gift Cards are not redeemable for cash or travellers cheques and will only be up to the value as stated on the Gift Card. The Gift Card does not have any monetary value and can only be exchanged for goods and services.
  7. Delivery
    1. We will use best endeavours to deliver the goods purchased by you to the address that you give to us within the timeframe specified. However we are not liable for losses suffered or incurred as a result of delay.
    2. The goods supplied are at your risk from the point of dispatch to your nominated address.
  8. Consumer Guarantees
    1. The Australian Consumer Law provides consumers with certain guaranteed rights (known as "Consumer Guarantees") which apply automatically whenever goods or services are supplied. These Consumer Guarantees include requirements that goods be of acceptable quality and do all the things that they are ordinarily used for. Services must be performed with care and skill.
    2. All goods supplied by Us come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure if the goods fail to be of acceptable quality. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and failure does not amount to a major failure.
    3. How long you can rely on a Consumer Guarantee depends on the price and quality of goods. There is no specified time limit. You may be entitled to rely on a Consumer Guarantee after any manufacturers' warranty has expired.

    5. All data and personal information stored on goods must be backed up by you before goods are returned. WOW accepts no responsibility for losses suffered or incurred as a consequence of data being lost through either repair or replacement of the goods.

    1. In fulfilling orders from this Service, we may collect your personal information, including your name, address, billing and delivery information, email address, gift recipient information and credit card details (all "Personal Information").

You must take your own precautions to ensure that the process which you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system. WOW takes no responsibility for any such damage which may arise in connection with your use of the Website.
  10. Disclaimer of Warranty and Limitation of Liability

We disclaim any warranties for the security, reliability, timeliness and performance of the Service. Neither we nor any other person involved in the creation, provision or maintenance of the Service shall be responsible for interruption of the Service, linkage to any third party sites, damage to your computer, damage to other property or loss of data resulting from your access to or use of this the Website and Service.
    2. To the fullest extent allowed by the law neither we, nor any other person involved in the creation, provision or maintenance of the Service, shall be liable for any direct, indirect, special, incidental or consequential damages arising out of your access to or use of this Service.

    We reserve the right to alter these Terms and Conditions at any time without notice to you. We will not be held responsible for any costs incurred as a consequence of amendment to these Terms and Conditions. Should we choose to provide you with notice of alterations to these Terms and Conditions, you hereby agree to receive from us email notification of the alterations.
  12. Governing Law
    This agreement shall be governed by the laws of Queensland, Australia and the parties submit to the jurisdiction of the Courts of that state.
  13. Severability
    In any court of competent jurisdiction finds any provision or part thereof of this agreement to be illegal, invalid or unenforceable that provision or part thereof shall be severed from this agreement and the remaining terms and provisions of this agreement shall remain in force and constitute the agreement between us.
  14. Entire Agreement
    These Terms and Conditions constitute the entire agreement between us with respect to the use of the Service.
  15. Waiver
    The failure by us to enforce any right or provision of this agreement will not constitute a waiver of the right or provision.
  16. Delivery
    You should allow 12 working days for your order to be shipped to your requested delivery address by mail. We cannot accept responsibility for delivery by Australia Post, AAE or other third parties.
  17. Definitions
    In these Terms and Conditions the following expressions shall have the following meanings unless otherwise stated:-
    1. Account means the personalised account created by you to become a Member.
    2. Material means any information (including but not limited to data, source codes, and drawings) or images in any form (whether visible or not) stored on or used in connection with the Website.
    3. Order means a request submitted by you to purchase Goods from WOW through the Website.
    4. Restricted Material means any goods displayed for sale on the Website, the sale of which is restricted to persons of a certain age.
    5. Service means the WebPages, software, networks, and processes associated with this Website including the purchase of Goods using the online purchase service operated by WOW
    6. Website means the internet site located at www.1wow.com.au including the mobile phone optimised sub - site operated by WOW.

The Australian Consumer Law recognises that the relevant time period can vary from product to product and that the appropriate remedy may also depend on how long it takes you to return the goods to Us.
